Frequently Asked Questions

Straight answers about IRS representation, tax resolution, and what to expect.

Services & Representation

What tax resolution services do you offer?+
IRS audits and audit defense, wage garnishment and bank levy defense, Offer in Compromise representation, unfiled returns compliance, penalty abatement, installment agreements, innocent spouse relief, and Federal Tax Court litigation. Nationwide representation in all 50 states.
Can you represent me if I live outside Florida?+
Yes. IRS representation is a federal practice. I represent taxpayers in all 50 states before the IRS and in Federal Tax Court. My state bar licenses in Florida, Colorado, and Texas are relevant for state tax matters, but IRS issues are handled nationwide.
Do you handle business tax problems too?+
Yes. Sole proprietors, partnerships, S-corps, C-corps, LLCs. Payroll tax problems, trust fund recovery penalties, unfiled business returns, employment tax audits. If the IRS is involved, I handle it.
What happens if the IRS is garnishing my wages?+
I can usually get a wage garnishment released within days. I contact the IRS immediately, assert your rights, and negotiate an alternative resolution. Time is critical. Call now, not next week.

Credentials & Experience

How long have you practiced tax law?+
32 years of federal tax litigation experience. Over $100 million in tax debt resolved through negotiation, settlement, payment plans, and litigation.
Why hire a tax attorney instead of a CPA?+
Attorney-client privilege. Your communications with me are legally protected and cannot be disclosed to the IRS. CPAs and enrolled agents don't have this privilege. Plus, only attorneys can represent you in Federal Tax Court.

Process & Costs

What does the consultation process look like?+
We talk. You tell me what's going on. I tell you what your options are. Free. No pressure. No sales pitch. If we're a good fit, I'll quote a fee and we get started.
How long does it take to resolve an IRS problem?+
Depends on the case. Levy releases can happen in days. Installment agreements take 30 to 90 days. Offers in Compromise take 6 to 12 months. Tax Court cases take 12 to 24 months. I set realistic expectations from day one.
Do I have to talk to the IRS myself?+
No. Once you sign a power of attorney, I handle all IRS communications. You should not speak to the IRS directly. If they contact you, refer them to my office.
Do you offer payment plans for legal fees?+
Yes. If you owe the IRS, you probably don't have a large sum sitting around for legal fees. I offer payment arrangements. Details are discussed during your consultation.

Offers in Compromise

What is an Offer in Compromise?+
An agreement where the IRS accepts less than what you owe. Qualification depends on your income, expenses, and assets. The IRS uses a specific formula. I evaluate whether you qualify before you invest time and money.
Can the IRS really settle for pennies on the dollar?+
Sometimes. But not always. The IRS will only accept what they believe reflects your true ability to pay. I'll be honest about whether your situation supports a low offer. Beware of firms that promise unrealistic results.

Penalties & Statute

Can IRS penalties be removed?+
Yes. Reasonable cause abatement and first-time penalty abatement are the two main paths. I analyze your situation and pursue every available basis for penalty relief.
Does IRS debt ever expire?+
Yes. The IRS has 10 years from assessment to collect. This is the Collection Statute Expiration Date. Certain actions can pause the clock. I calculate your exact CSED to determine if waiting it out is viable.
